My H1-B papers were filed in 2005 by one Company. I went to the Embassy in November 2005. They said that my application needs Administrative processing. They said they will contact me once it is finished. Till now they haven’t contacted me. They are not responding to my email queries. Now another company is ready to file my H1-B
papers for year 2007, can I go forward for the new H1-B? In this case what will be the status of my previous H1-B file?

I was glad to come across an informative and user friendly site. I have two questions: First, how can I check my H-1B visa status? My H-1B was filed on 23rd November 2000. My future employer gave me the EAC number, but I have not heard from him after that, except that the INS had asked the company certain queries, which were duly answered. Does INS normally take this long to approve an H-1B? It is nine months since the papers were filed. I am concerned. Please let me know what I can do in these circumstances.

For the last one-and-a-half year, I was working with a client in the US. After the completion of the assigned project, my company failed to find another client for me. With effect from August 2001, the company gave me one-year leave. My husband is also working with the same company at another client site. I have applied for the green card and the process has commenced. My company is not going to cancel my H-1B visa and it is willing to continue with the green card process. Do I need to change my status from H-1B to H-4?
As your employer has agreed to grant you leave for a period of one year, you do not have to change status. In addition, the green card processing may be endangered by change in status.

I called the automated INS number to check my status. I was informed my visa had been approved. I have been receiving the same message for the past few weeks. But I have not received the visa papers. Does the INS change the content of the message if the visa is revoked?
Please ask a friend to call the INS and pretend he is your employer to find your true visa status. You could also solicit the services of a lawyer.

If one is already in the US and is applying for
change of status, does one need to opt for the visa stamp I have no intentions of traveling outside the US for quite some time. Could you also let me know whether I can determine the status of my case at the INS by dialing the Service Center number and telling the authorities my name?

If you are in the US and plan never to travel outside the country while
under H-1B status, you need not get the new status stamped. However
practically this is impossible. In case of an emergency, you may need to
travel to your home country. Hence, it would be better to get your new
status as regards H-1B stamped on your passport. As regards the status of

I have heard that my company is soon going to be brought by another company? This has caused a great deal of confusion among H-1B workers employed in the company. According to my knowledge, the H-1B is an employee-specific visa. Will the H-1B still be valid after the takeover? Please advise.

Do not worry. According to the INS, in case of a takeover, the successor company undertakes all rights, liabilities, assets and privileges of the previous employer.
H-1B visas are, hence, valid even after the takeover. We would, however, advise you to call the INS and confirm this.

My H-1B application was filled on 3rd, November 2000. Some of my friends’ H-1B applications were filled in last week of November 2000. I received my EAC number on 17th November 2000, whereas my friends received their EAC numbers in December 2000. All my friends' visa applications have been approved. Could you please let me know what has gone wrong with the application? What are the factors that might affect an application's processing (provided all documents are correct). Does INS process applications, depending on the reputation of the company. Could you tell me the resources from where I could verify whether the EAC number given by the company is valid? Thanks.
