H-1B Visa Fee

Hi I am holding a h1 b visa This is my second visa and is expiring next month Is there any rule which says that I cannot apply for any more h1b visa. --Sameer

On H1 you have to be 6 yrs in US and one year outside US.

I possess H1B visa status, issued to me in Jan 2004,by my previous employer. Now, I need to go to US on a B1 visa with my present employer(IBM).What are the chances of getting a B1 Visa in this case? I have heard that the Embassy stresses more on the number years spent with the current employer. Since my service with the present employer is less than a month, will this be an issue at the time of interview at the consulate office ? Does the company name and its relationship with the Embassy matters?

The name IBM should be enough....but the embassy looks for a minimum of 3 months...or there should suffcient evidence why u need to travel to USA immediately after joining.

I got my H1B visa stamped at US consulate in France. Can I go back to my home country and fly to US directly or do I need to compulsorily fly from France because visa is stamped from France?? What kind of queries can be expected if I fly from my home coutry to US directly at the Immigration check?? Thanks in advance

It does not matter where you fly in from as long as your documentation is in order.

In August 2000,twice my B-1 visa was rejected by US consulate Mumbai.The reason on both ocassions was cited as I donot possess strong ties with India.Perhaps the facts that i was not married,i cudnt show property in my name and my company standing(it was a startup company with offices in New Jersey,USA) may have been the reasons.My papers other than these handicapps were complete.Since May 2001 i m in germany .A company in US will file the petition for my H1 B visa before the INS this year.Is it possible that past B-1 rejections may stand as a hindrance to my H1 visa approval and subsequent stamping?Fyi,my qualification is B.Sc from Dibrugarh University, Assam. with two Sun Certifications and I have completed 5.5 years in Software Developement .

The norms for B1 and H1 stamping are different and if your h1 documentation is proper we donot forsee any problems.

You have to wait to till next year till an emloyer can apply for your h1 and that is the legal way to work in the USA.

If the transfer application is made before the end of 30 days of arrival in the USA, there is a slight chance the transfer may be approved. Also please ensure that the employer who applied for the H1 has not cancelled the H1 and it is good to note that BCIS / INS requires atleast 2-4 pay stubs generally.

Please can you let me know the cost of the H-1B visa?

The NIV application fee is Rs 2,115. This fee is non-refundable and payable whether a visa is issued or not. The immigration fee is Rs 3,525. The fees must be paid by demand draft only, payable to the American Consulate General, of your particular Consulate. The Consular fees will be accepted by way of demand drafts issued by nationalised and foreign banks only. Remember that separate demand drafts are necessary for the application and issuance fees. Your name and passport number must be included on the reverse of the demand draft. Demand drafts without this information will not be accepted.

Has the H-1B “training fee” been increased?

Yes, in a separate piece of legislation (H.R. 5362), the amount of the fee has been increased to $1,000 The fee increase will be effective two months after enactment
