H-1B extension

 
I have been working in US from August 2005 on blanket L1 visa for Company A. I also got H1B visa from company B in Feb 2005. It was not stamped. It is valid till September end, 2007. I wanted to work on L1 visa till 2008 January. Can I shift to company B by revalidating /extending H1B visa in Jan 2008? Please clarify. I applied for H1B through company C now. As there is huge demand, I do not know whether I will get new H1B or not.

  1. Your H1B is not valid until you have joined for work with Company B.
  2. You cannot shift to Company B in 2008 because the visa validity (H1) ends in September 2007, and hence, the only option you have is to join Company B on the H1 and then extend your visa immediately.
  3. This year's H1B visas are through a computer based lottery.

I am currently in US with a approved H1-X (extesion visa) . My H1-B had expired in October 2004. I want to ask the folloiwng questions:

1) Can my husband come to US on dependant visa. Do i have to necessarily get it stamped outisde US. Can it be stamped in US?
2) My husband is planning to pursue higher studies in US. How difficult is it or easy to get F1 visa when i am in US on H1-B. What do you recommend. Should he come to US on a dependent visa and then convert it into F1 or should he come here on F1 directly. What is the probality of him getting F1 visa?

All visas are stamped in the native country.
To get F1 depends on the university as how long they'll take.
After getting F1 visa, ha can study on the F1 but when traveling outside US, stamping is required

I am in US now and my H-1B is valid until mid of May.
1. Do I need to get my H-1B renewed only in India ???
2. What are all the documents my employer need to give me for the renewal. Same employer I am going to work for even after renewal.
3. I need to use TT Services in Hyderabad or I need to go in person to Chennai ???
4. If I apply through the TT Services, how long the process going to take. My project schedules are very tight. Will it be faster if I go in person and do they allow that (going in person for H-1Bs)
5. What are all the documents I need to produce to/at the consulate along with the paper work from my employer (like Photoes / DDs).

Your employer has to file for extension off H1 B visa.

I got H1B visa documents in Oct 2004, and I got H1B visa stamped in Nov 2004. I want to got to USA in the Month of April 2005, so there will be any time limit to enter USA after H1B stamped. I want to Enter USA after 5 months.

You can enter US in April 05, but have current offer letters before entering US.

Iam on 8th year extension H1-B visa and my wife is on H-4 visa.. Will it be a problem to go to Chennai for visa revalidation stamping ?

Normally it is only 6 yrs in the US. Talk to your lawyer before going for stamping.

My Employer wishes to file and H-1B extension for me after my initial 3 years are up. Is the extension valid for 2 or 3 years?Thanks!

I am on H1-B Visa Extension (after 6 years) based on GC filled 1 year before expiry of visa with current employer A.
Can I change the Job ?
If my new Employer B will have same position and same job, and Employer B is within 50 miles radius of my filed GC location, can i change the job?

1. You can change your job after your labor is completed or what is known as EAD is through You can do the change after your federal and state labor is over.

2. But you must ensure that the employer does not cancel the application or file any objections or state that the circumtances under which your greenc ard was applied for has changed. Then you are in BIG trouble.

A year back I came to the US on an an H-1B visa. My employer however didn't have any projects and am jobless. Now I am worried about my status. Is it mandatory to file returns at the end of first year? Second, my visa stamping is valid till may 2003. If I continue to stay without filing tax returns and get a job or before the visa expires, will my H-1B visa be extended?

We recommend that you find a job fast. If you fail to do so, you need to consider the option of returning to India. The INS has started tracking expatriates without jobs. The IRS supports the INS in its work. Hence, if you have not paid taxes, you are in jeopardy and need to return.

The first three years of my H-1B visa will expire in Feb 2002. I wish to extend my visa for a further three years. What is the procedure for extension? I understand one cannot submit one's passport for visa extension until the last 60 days of the visa expiry date. I wish to travel during this 60-day period. Is it possible to do so or must I remain in the country till the visa is extended?

It is advisable to remain in the US during the 60-day period to handle any objections raised by the Service Centers. When you apply for extension, you will have to submit your passport alongwith he application for extension. Hence, you cannot leave the US. Please also consult your company's attorney.

I am currently on an H-1B visa. Before recruiting me, the company had applied for a blanket LCA on my behalf. The LCA expires in mid-2003. My H-1B also expires on that date. In April 2001, I arrived in the US. Hence, I have stayed for merely two years on the H-1B. In case the company once again applies for a two-year blanket LCA, can I apply for an extension a second time to complete the six-year time frame? I have been informed that the H-1B extension can be obtained twice on a three year (initial) + two year + one year basis. This somehow does not apply to my case favorably. I would appreciate if you could throw some light on this.

The total period you can stay in the US is six years, irrespective of the number of H-IB applications or transfers filed.

Hello, I got my first H1 in March 99 and 6 years of H1 was suppose to be done in March 05. But I got the valid date and i-94 till june 06. After consulting lawyer, i didn't file for 7th year extension before March of this year now it seems the lawyer gave me wrong suggestion. If I apply for 7th year extension now what are the chances that they will deny it? If they deny my H1, can i change my status to F1? thanks in advance.

1. BCIS will have the information that your H1B visa is approved and if the visa is approved and not sent to you or your attorney, then the visa is under process

2. You can travel to US on B1.

3. Please ensure that you talk to your attorney who applied for your B1, this is needed because if your H1B visa is under process, then this information will be sent to your attorney and the information will be available at the port of entry.

4. At the port of entry, Pl tell that you have not received H1-B visa.

5. You can apply for the date of stamping at a later date by you / your company through www.ttsvisas.com site.

6. Although there will be no major issue at port of entry
